S Anjani Infotech provides professional services including, but not limited to, Shopify development, WordPress development, website design and development, e-commerce development, mobile application development, custom software development, integrations, maintenance, technical support, graphic design and other digital services.
The specific services to be provided to a client will be determined by the applicable quotation, proposal, statement of work, invoice, project agreement or written communication agreed between the parties.
Clients are responsible for providing accurate content, images, text, credentials, access, documentation, specifications and other materials required to perform the services. The client represents that they have the necessary rights and permissions to provide such materials to us.
Content, designs, code, graphics, documents and other materials supplied by the client remain the property of the client or their respective owners. The client grants S Anjani Infotech permission to use such materials solely for the purpose of providing the agreed services.
S Anjani Infotech reserves the right to refuse or discontinue work involving content, materials or requests that are unlawful, infringe third-party rights, or otherwise create legal, security or ethical concerns.
3. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
3.1. In any way that violates any applicable national or international law or regulation.
3.2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.

4. Project Scope and Additional Work
Services will be provided according to the scope, specifications, quotation, proposal, invoice, statement of work or project agreement approved by the client.
Any functionality, design changes, revisions, integrations, features, content changes or other work requested outside the agreed scope may incur additional charges. Additional work may be billed at our applicable hourly rate or at a separately agreed fixed price.
Estimates and timelines provided by S Anjani Infotech are based on the information available at the time of estimation. Changes in requirements, third-party services, client delays or unforeseen technical issues may affect the final cost and delivery timeline.
5. Payment Terms
Projects and services may require an advance payment, milestone payment or full payment before work begins, as specified in the applicable quotation, proposal, invoice or project agreement.
S Anjani Infotech may not commence work until the required payment has been received.
Any outstanding balance must be paid within the payment period specified on the applicable invoice. If payment is delayed, S Anjani Infotech reserves the right to pause work, suspend services, delay delivery or withhold project files, credentials, source files or deployment until outstanding amounts are paid.
Payments made through third-party payment processors, banks or other financial institutions may be subject to their respective processing times, fees and terms.
6. Refunds and Cancellation Policy
Once a service, milestone, or agreed deliverable has been completed and delivered, the corresponding payment is final and non-refundable, subject to any mandatory rights available to the client under applicable law.
Payments cover the time, resources, planning, design, development, testing, communication, project management and other work performed or committed by S Anjani Infotech. Accordingly, a client is not entitled to a refund because of a change of mind, cancellation, delay caused by the client, failure to provide required information or access, or dissatisfaction where the agreed scope has been substantially completed or delivered.
If a client cancels a project after work has started, all payments already made will remain non-refundable, and the client remains responsible for payment of any outstanding amount relating to work already completed or committed before cancellation.
Where applicable law provides a mandatory right to a refund or cancellation that cannot legally be excluded, that legal right will continue to apply.
S Anjani Infotech may, at its sole discretion, consider a refund or credit in exceptional circumstances. Any such refund or credit will be discretionary and will not create an obligation to provide refunds in future cases.
7. Client Responsibilities and Delays
The client is responsible for providing accurate content, credentials, access, approvals, feedback, materials, specifications and other information reasonably required to complete the project.
Delays caused by the client, including delayed feedback, approvals, access, content, payment or information, may affect the project timeline. Such delays will not be considered a failure by S Anjani Infotech to deliver the services.
Where client delays significantly affect the project, S Anjani Infotech may revise the delivery schedule and, where applicable, charge additional fees for additional time or resources required to resume or complete the project.
8. Project Completion, Delivery and Revisions
Work will be considered delivered when the agreed scope or applicable milestone has been completed and made available to the client for review, approval, implementation or deployment.
The client is responsible for reviewing delivered work and providing feedback or requested revisions within a reasonable period.
Revisions included within the agreed project scope will be handled according to the applicable quotation or project agreement. Requests outside the agreed scope may be treated as additional work and charged separately.
Once the agreed work has been completed and delivered, the project or applicable milestone may be considered completed even if the client does not immediately deploy or use the delivered work.
9. Third-Party Services
Projects may depend on third-party platforms, applications, hosting providers, APIs, plugins, themes, payment gateways, software, domains, servers, app stores or other external services.
S Anjani Infotech is not responsible for downtime, service interruptions, pricing changes, policy changes, restrictions, compatibility issues, security incidents, suspension, termination or other failures caused by third-party providers.
Third-party fees, subscriptions, licenses and usage charges are normally the responsibility of the client unless otherwise agreed in writing.
10. Analytics
We may use third-party Service Providers to monitor and analyze the use of our Service. Such providers may collect information in accordance with their own terms and privacy policies.
11. Accounts
When you create an account with us, you guarantee that you are above the age of 18, or otherwise have the necessary legal authority to enter into an agreement, and that the information you provide is accurate, complete and current at all times.
You are responsible for maintaining the confidentiality of your account credentials and for all activities or actions performed through your account.
You must notify us immediately upon becoming aware of any unauthorized use or security breach involving your account.

The Service, including its original content, features and functionality, excluding client-provided content and materials, are and will remain the property of S Anjani Infotech and its licensors.
Unless otherwise agreed in writing, S Anjani Infotech retains ownership of its pre-existing code, frameworks, libraries, development methods, reusable components, templates, tools, know-how and other intellectual property used in providing services.
Where a project specifically provides for transfer of ownership of custom deliverables, such transfer will be subject to full payment of all amounts due and will apply only to the deliverables expressly identified in the applicable agreement.
Third-party software, plugins, themes, libraries, fonts, stock images and other licensed materials remain subject to their respective licenses and terms.
Nothing in these Terms grants the client ownership of S Anjani Infotech's pre-existing intellectual property unless expressly agreed in writing.
13. Copyright Policy
We respect the intellectual property rights of others. It is our policy to respond to claims that content posted on or through the Service infringes the copyright or other intellectual property rights of any person or entity.

14. Confidentiality

You acknowledge and agree that S Anjani Infotech may use general feedback, suggestions and ideas for improving its services, provided that confidential or proprietary client information is not improperly disclosed.

Services are provided based on the agreed project scope and requirements. While S Anjani Infotech will use reasonable skill and care in performing the services, we do not guarantee that websites, applications, software, integrations or other deliverables will be completely free from errors or interruptions.
We do not guarantee specific business results, sales, rankings, traffic, conversions, revenue or other commercial outcomes unless expressly agreed in writing.
Any warranty or support period specifically included in a project agreement will apply only to the scope and conditions stated in that agreement.
Payment obligations are based on the performance and/or completion of the agreed services and deliverables and are not dependent on the client's sales, revenue, traffic, conversions, rankings, business performance or other commercial results, unless expressly agreed otherwise in writing.
18. Limitation of Liability
To the maximum extent permitted by applicable law, S Anjani Infotech shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, business opportunities, data or goodwill arising from or related to the use of our Service or services provided.
S Anjani Infotech shall not be responsible for losses resulting from third-party services, hosting providers, platforms, plugins, applications, APIs, payment providers, domain providers or other services outside our reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

If a client wishes to terminate a project or service, the client may notify us in writing. Termination does not automatically entitle the client to a refund, and all amounts due for work completed or committed before termination remain payable.
All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, payment obligations, warranty disclaimers, confidentiality, indemnity and limitations of liability.
20. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising in connection with these Terms or the services provided by S Anjani Infotech shall, to the extent permitted by applicable law, be subject to the jurisdiction of the appropriate courts in India.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

S Anjani Infotech may display completed projects, designs, websites, applications, screenshots and general descriptions of completed work in its portfolio, website, proposals, presentations and marketing materials, unless the client has specifically requested in writing that the project remain confidential or not be publicly displayed.
We will not intentionally disclose confidential business information, credentials, private customer information or other confidential materials belonging to the client.
25. Acknowledgement
BY USING SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
